Post-Nuptial Agreement in Sarawak, Is It Valid?

Q1. Is a post-nuptial agreement legally valid in Sarawak?
Under the current Court of Appeal ruling, post-nuptial agreements cannot presently be relied upon as valid and enforceable matrimonial agreements under the LRA 1976 until the rules contemplated by Section 56 are made.
Q2. What is the difference between a prenuptial agreement and a post-nuptial agreement?
A prenuptial agreement is signed before marriage, whereas a post-nuptial agreement is signed after marriage. Both may address financial arrangements and matrimonial matters.
Q3. Can a husband and wife agree on how to divide their properties?
Yes. Spouses may negotiate a property settlement. However, a private agreement does not automatically override the Court’s powers under Section 76 of the LRA 1976.
Q4. If both spouses voluntarily sign a post-nuptial agreement, is it binding?
Not automatically. Mutual consent and signatures alone do not make a post-nuptial agreement enforceable in matrimonial proceedings under the current legal position.
Q5. Can a post-nuptial agreement determine child custody and maintenance?
Parents may propose arrangements concerning their children, but the Court retains jurisdiction to determine matters affecting their welfare, custody and maintenance.
Q6. What if the matrimonial property is registered under only one spouse’s name?
Registration under one spouse’s name does not necessarily exclude the other spouse from making a matrimonial asset claim. The Court will consider the relevant factors under Section 76.
Q7. Can a spouse waive all future maintenance through a post-nuptial agreement?
A private post-nuptial agreement cannot automatically remove the Court’s statutory powers concerning maintenance. Any proposed waiver or settlement must be considered under the applicable law.
Q8. Can spouses still agree to a settlement before filing for divorce?
Yes. They may negotiate settlement terms and, where appropriate, present them to the Court through a Joint Petition for Divorce or consent terms for approval.
Q9. Are native customary marriages in Sarawak subject to the same law?
Not necessarily. Certain marriages governed by native customary law fall outside the LRA 1976 and may be governed by separate legal provisions.
Q10. Should I engage a lawyer before signing a post-nuptial agreement?
Yes. A family lawyer can advise whether the intended arrangements are legally permissible, how they may be implemented and whether court approval is required.
